Judge Kimbler's criminal docket for May 11, 2020

Medina County Common Pleas Judge Joyce Kimbler's criminal docket for April 30. Wadsworth man sentenced for assault Phillip D. Marshall, 665 Easter Road, Wadsworth, was sentenced to the Medina County Jail for assault, a first-degree misdemeanor. Kimbler gave Marshall a 180-day jail sentence with credit for two days served but suspended the remaining 178 days. Kimbler placed Marshall on supervision for three years. Conditions of supervision include doing 40 hours of community service, having no contact with the victim without the consent of the Medina County Adult Probation Department and doing any recommending program including anger management and domestic violence programming. Cleveland man sentenced for patient abuse Derrick Clarke, 4321 Storer Ave., Cleveland, was given a jail sentence of 30 days for patient abuse, a fourth-degree felony, with credit for three days served. When released from the Medina County Jail, Clarke will be supervised for two years with conditions that include 40 hours of community service, drug/alcohol/mental health assessment if required by the Medina County Adult Probation Department, no possession or consumption of any alcoholic beverages and no contact with the victim. He is also prohibited in employment that involves care of the elderly, mentally ill or physically disabled. Any violation of these conditions could result in a prison sentence of 11 months. Creston man receives jail sentence for aggravated possession of drugs Michael Allen, 200 Jackson Road, Creston, was sentenced to the Medina County Jail for 22 days with credit for 22 days served. Allen is also facing a felony theft charge in Wayne County Common Pleas Court. Medina man sentenced for domestic violence Derrek Andrews, 4391 Great Smokey Circle, Medina, sentenced for one charge of domestic violence, a felony of the fourth degree. Andrews is to be assess for incarceration at the Community Based Correctional Facility in Lorain County. A CBCF is a lock-down institution that handles prisoners who have drug and/or alcohol problems. The CBCF can hold a defendant for up to six months. While at the facility the defendant is required to take programming. Kimbler ordered Andrews to be held at the Medina County Jail until a bed becomes available. Two Elyria men sentenced for non-support of dependents Kevin Welch, 129 Pennsylvania Ave., and Adam Zelis, 39495 Chestnut Ridge Road both of Elyria, were sentenced separately for non-support of dependents. Both men were sentenced for non-residential community control sanctions. They are required to pay child support, including any arrearages, engage in gainful and verifiable employment, obtain a drug/alcohol assessment and refrain from consuming any alcohol or marijuana. They were also ordered to attend classes on parenting, budgeting and handling finances. Violation of these conditions could lead to a 12-month prison sentence.
